Terms and Conditions of Sale for Easy Training Tools Products
These terms and conditions are to be read together with the applicable quote of invoice and the terms of any service selected by the customer. The following terms and conditions govern the sale by Easy Training Tools ("ETT") to customers of the products and services (the "Products"). By accepting delivery of the products described on the invoice, the customer agrees to be bound by and accepts these terms and conditions.
1. Amendments
Customer may not alter, supplement, or amend these terms and conditions under any circumstances. Any attempt by the customer to supplement, alter, or amend these terms and conditions, or to enter into an order for products that is subject to additional or altered terms and conditions will be null and void, unless otherwise agreed to in a written agreement signed by both the customer and ETT. ETT may alter or make amendments to these terms and conditions as they relate to future sales or deliveries at any time without prior notice.
2. Governing Law
This document shall be governed by and construed in accordance with the laws of the Republic of Ireland and the parties hereby agree to the non-exclusive jurisdiction of the courts of the Republic of Ireland.
3. Payment Terms
Credit terms are within the sole disretion of ETT and unless otherwise specified in ETT's invoice, payment must be received by ETT prior to ETT's acceptance of an order. Payment for the products will be made via PayPal.
4. Shipping Charges and Taxes
Separate charges for shipping and handling will be shown on ETT's invoices. Unless customer provides ETT with valid and correct tax exemption information applicable to the products purchased the customer is responsible for goods and services tax, and all other taxes associated with the order, however designated. If applicable, a separate charge for taxes will be shown on ETT's invoice(s).
5. License Agreement
This software is supplied to you by Easy Training Tools in consideration of your agreement to the following terms, and your use, or modification of the product constitutes acceptance of these terms.
If you do not agree with these terms, please do not use, or modify the product. In consideration of your agreement to abide by the following terms, and subject to these terms, ETT grants you a personal, non-exclusive license, to use, and, modify the product. Neither the name, trademarks, service marks or logos of Easy Training Tools may be used to endorse or promote products or services derived from the product without specific prior written permission from ETT.
The customer is free to download, use, and modify the product(s) for the purposes of holding training courses, seminars, or similar activities. Course materials in the form of handouts may be distributed to attendees of such courses/seminars.
As part of the purchase agreement the customer may hold multiple courses, seminars, or similar activites based on the product.
The customer must not redistribute the product in any way with the exeption of handout materials identified within the product.
6. Returns Policies
ETT's return policy provides that customers who buy products directly from ETT may return them to ETT up to 7 days after the date of the Invoice for products for a refund of the product purchase price if the same has already been paid by the customer. The customer must send signed, written confirmation via fax or mail stating that all files associated with the product have been deleted from the customers computer(s), and email.
8. Products
ETT's policy is one of ongoing product update and revision. ETT may revise and discontinue products at any time without prior notice. ETT shall use its reasonable efforts to ensure that the catalog of products on its website is up-to-date, but ETT makes no guarantee that all products listed in the online catalog will be available at all times or any time.
